  • NISG 2026 (NIS2)

    NIS2 for federal and state governments

    Public administration entities are classified by level, not by size: federal level essential, state level important. Schools and higher education, the judiciary and areas such as national defense and law enforcement are not essential or important (§ 24(6) NISG 2026). Municipalities and associations of municipalities do not belong to the public administration sector (§ 24(3)); their operations may be covered through the sectors in Annexes 1 and 2. Management bodies take part in cybersecurity training (§ 31(2)).

  • LAW

    Freedom of information since September 1, 2025

    Information of general interest must be published proactively on the internet; requests for information must be answered within four weeks (§§ 4, 8 and 20 IFG).

  • Accessibility

    Accessible websites and apps

    Websites and mobile applications of the federal government must be accessible (§ 1 WZG). The underlying EU directive requires an accessibility statement (Art. 7 Directive (EU) 2016/2102).

  • GDPR

    Data protection officer

    Public authorities and bodies designate a data protection officer in every case (Art. 37(1)(a) GDPR).

Is our organization subject to NIS2?

In public administration, the level decides, not the size: federal level essential, state level important. Schools and higher education, the judiciary and areas such as national defense and law enforcement are not considered essential or important. Municipalities and associations of municipalities do not belong to public administration; their operations, for example for drinking water or wastewater, may still be covered.
